Resale Terms & Conditions

Everything explained in plain & simple language

A customer placing an order on SharePal's website (www.sharepal.in) or through an online order form agrees to abide by the following terms and conditions:

1. ELIGIBILITY:

You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to make purchases from the Platform.

2. PRODUCT CONDITION & AUTHENTICITY:

All resale products listed on SharePal are pre-owned or refurbished, inspected, tested, and certified by SharePal’s quality team.

The condition of each product (such as “Excellent” or “Good”) is clearly mentioned on the product page before purchase.

Accessories and add-ons, where provided, will be clearly stated in the product description.

3. PRICING AND PAYMENTS:

All prices listed are inclusive of applicable GST and other taxes, unless specified otherwise.

Payments must be made in full at the time of placing the order through the available payment options on the Platform.

SharePal reserves the right to cancel any order in case of pricing errors, stock unavailability, or payment failures. Any amount collected in such cases will be refunded in full to the original payment method.

4. DELIVERY AND HANDOVER:

To deliver your order as soon as possible, we courier your product(s) using some of the best couriers in India. The customer must ensure accurate shipping and contact details to facilitate smooth delivery. SharePal shall not be held liable for delays due to courier issues, force majeure events, or incorrect address information provided by the customer.

5. WARRANTY AND AFTER-SALES SUPPORT:

All resale products sold on SharePal come with a standard 3-month limited warranty from the date of delivery.

Accessories such as batteries, memory cards, mounts, and cables carry a 1-month warranty unless otherwise stated.

The warranty covers functional defects and hardware malfunctions under normal usage.

Warranty does not cover:

• Physical damage, water damage, or tampering

• Damage due to mishandling, misuse, or unauthorized repair

• Software issues, user data loss, or normal wear and tear

Warranty claims will be inspected by SharePal’s technical team, and products may be repaired or replaced at SharePal’s discretion.

The warranty is non-transferable and applies only to the original purchaser.

6. REFUNDS AND RETURNS:

All refund and return requests are governed by the Refund Policy of SharePal Resale, available on the Platform.

Customers are encouraged to review this policy before initiating a return or warranty claim.

7. LIMITATION OF LIABILITY:

SharePal shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use any resale product.

The total liability of SharePal, in any event, shall not exceed the purchase price of the product in question.

SharePal does not guarantee manufacturer warranties on pre-owned products unless explicitly mentioned.

8. CUSTOMER RESPONSIBILITIES:

Customers are responsible for verifying the specifications and condition of the product before completing the purchase. Any attempt to alter, tamper, or misuse the product post-purchase may result in warranty voidance.

Customers must retain the original invoice and packaging for warranty or refund claims.

9. GOVERNING LAW, JURISDICTION AND DISPUTE RESOLUTION:

The Terms and the use of the website are governed by and construed in accordance with the laws of India.

In the event any dispute or difference arises between the User and SharePal in connection with the validity, interpretation, termination and implementation or alleged breach of any provision of the Terms (“Dispute”), both Parties hereto shall endeavor to settle such dispute within a period of 14 days, amicably with each other and in good faith.

Upon failure to amicably settle any Dispute, the dispute shall be resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. Notwithstanding anything to the contrary contained herein, any dispute, controversy and/or claim arising out of and/or relating to this contract, including its construction, interpretation, meaning, scope, operation, effect and/or validity thereof (“Dispute”), shall be resolved by arbitration, administered by Presolv360, an independent institution, in accordance with its Dispute Resolution Rules (“Rules”).

The parties agree that the arbitration shall be before a sole arbitrator appointed under the Rules. The juridical seat of arbitration shall be Bengaluru, India. The language of the arbitration shall be English. The law governing the arbitration proceedings shall be Indian law. The decision of the arbitrator shall be final and binding on the parties. Subject to the above, the competent courts at the seat shall have exclusive jurisdiction.

The parties agree to carry out the arbitration proceedings virtually through the online dispute resolution (“ODR”) platform of Presolv360 (https://presolv360.com/) and, for such purpose, the email addresses and/or mobile numbers available, provided or otherwise referenced in the contract shall be considered. Each party shall be responsible for intimating such institution in the event of any change in its email address and/or mobile number throughout the arbitration proceedings. In the event the arbitration proceedings cannot be administered virtually in the opinion of the arbitrator, the proceedings shall be conducted physically, and the venue of the proceedings shall be as determined by the arbitrator having regard to the circumstances of the case, including the convenience of the parties.

The courts of Bengaluru, India shall have the sole and exclusive jurisdiction in respect of any matters which may be instituted before any court of law, arising from the use of the services offered by SharePal.

10. AMENDMENTS:

SharePal reserves the right to modify, amend, or update these Terms and Conditions at any time. Continued use of the Platform after such updates constitutes acceptance of the revised Terms.
